米国特許の仕事を始めてから25年、この間数多くの特許出願書類や中間処理業務の書類を作成してきました。
今回は、その経験から得た「強い米国特許を獲得するための書類作りのポイント」を5回に分けてご紹介いたします。

強い米国特許を獲得するために
第1回 概観
私が特許申請書類を書く時（もしくは、若手弁護士のドラフトをレビューする時や、外国の方が作られた書類のネイティブチェックをする時）に通常目標としていることは、特許を弱くする用語を避け、クレームが発明とデザインアラウンド（特許侵害を回避するために，デザインや仕様を変更したもの）となる可能性があるものを幅広くカバーし、クレームが明細書に裏付けられており、記述内容が米国特許法101条の特許適格要件や米国特許法112条の実施可能要件・記述要件に従っているかを確認することです。私の書いたものが一方ではクレームの範囲を広め、他方では特許の有効性を攻撃する兵器（攻撃対象となるもの）をなくすため、特許申請に付加価値を与えられるものと確信しております。

Part 1 of 5: Strong Patent, Generally
When I write a patent application (or review a patent application drafted by a junior attorney or do a native check of a patent application), my objectives are generally to avoid patent-weakening terms, make sure the claims broadly cover the invention and potential design-arounds, make sure the claims are supported by the description, and make sure the patent application complies with patent eligibility requirements of 35 USC 101, and the enablement and written description requirements of 35 USC 112. I believe my writing adds value to a patent application because my writing broadens the scope of the claims on the one hand, and removes invalidity weapons on the other hand.
